The reason being that all of the principals are dead, and the dead can’t sue. That's Frank "Lefty" Rosenthal, reinterpreted in "Casino" as the character Sam "Ace" Rothstein, played by Robert De Niro in a similar scene that both opens and closes the movie. He doesn’t tell conventionally narrative stories but rather uses real-life anecdotes to guide the audience through the rise and fall of the protagonists in the movies.
